TERMS AND CONDITIONS

1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to businesses with a valid ABN operating in Australia (“Eligible Business”).

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

4. Promotion commences on 19/06/2023 and final entries close at 11:59pm AEST on 11/08/2023 (“Promotional Period”).

5. To enter, an authorised representative, on behalf of an Eligible Business, must visit www.wemakepossible.com.au, follow the prompts to the promotion entry page, input the requested details including but not limited to the ABN for the Eligible Business and an answer to the question What would you make possible with $5K worth of design, print and/or signage services?” in 150 words or less, and submit the fully completed entry form during the Promotional Period.

6. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Businesses and reserves the right, in its sole discretion, to disqualify any Eligible Business that the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Only one (1) entry is permitted per Eligible Business.

9. The judging will take place at Kwik Kopy Australia Pty Ltd, 9/50 Berry Street, North Sydney NSW 2060 commencing on 16/08/2023. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. Winning Eligible Businesses will be notified by telephone and email. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question.

10. The Promoter’s decision is final and no correspondence will be entered into.

11. The best three (3) valid entries, as determined by the judges, will each win $5000 worth of Design, Print and Signage Services from Kwik Kopy, awarded in the form of a credit to the winning Eligible Business at Kwik Kopy. The full amount must be redeemed at once (in one transaction) and by no later than 11:59pm AEST on 27/11/2023.

12. Prizes will be awarded to the owner/manager of the Eligible Business regardless of who submitted the entry on behalf of the Eligible Business.

13. If for any reason a winning Eligible Business does not redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

14. Total prize pool value is $15,000.  

15. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

16. Authorised representatives who submit an entry on behalf of an Eligible Business, agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Authorised representatives warrant and agree that:

(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; 

(b) their Content shall not contain viruses or cause injury or harm to any person or entity; 

(c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content; 

(d) the Content is the original literary work of the authorised representative that does not infringe the rights of any third party;

(e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and

(f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, the authorised representative agrees to indemnify the Promoter for any breach of the above terms.

17. As a condition of entering this promotion, each authorised representative that submits an entry on behalf of an Eligible Business licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

18. Authorised representatives, on behalf of an Eligible Business, consent to the Promoter using their name, likeness, image and/or voice (and that of the Eligible Business) in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Business; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

20. Any cost associated with accessing the promotional website is the Eligible Business’s responsibility and is dependent on the Internet service provider used. 

21. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Eligible Business. Eligible Businesses should seek independent financial advice in this regard.

22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Business; or (f) use of a prize.

 24. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.kwikkopy.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business. The Privacy Policy also contains information about how Eligible Businesses may opt out, access, update or correct their PI, how Eligible Businesses may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose personal information to any entity outside of Australia.

TERMS AND CONDITIONS

1.    Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.    Entry is only open to Australian residents aged 18 years or over (excluding NT/TAS) (“Eligible Individuals”) and businesses operating in Australia (excluding NT/TAS) with a valid ABN (“Eligible Business”). Eligible Individuals and Eligible Businesses may be collectively referred to as (“Eligible Entrants”) where relevant. 

3.    Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

4.    The promotion commences on 19/06/2023 and closes at 11:59pm AEST on 11/08/2023 (“Promotional Period”). Entries into the promotion open on 19/06/2023 and final entries close at 11:59pm AEST on 14/08/2023 (“Entry Period”).

5.    To be eligible to enter and receive a digital scratch card, Eligible Individuals or authorised representatives on behalf of an Eligible Business, must spend $250 (inc GST) or more in a single transaction at participating Kwik Kopy centres in Australia excluding NT/TAS and have their order fulfilled (“Qualifying Transaction”) during the Promotional Period and provide their email address at time of making the Qualifying Transaction. For clarity fulfillment of an order means that it has either been delivered or been collected during the Promotional Period.

6.    Eligible Entrants will receive an email to the email address provided within two (2) business days of making a Qualifying Transaction. Eligible Entrants must then, within the Entry Period, click on the link within the email and scratch the digital game card, when prompted, to reveal if they have won a prize. To claim a prize, Eligible Entrants must, input the requested details (including business details if entering on behalf of an Eligible Business –including an ABN) and submit the fully completed online claim form within the Entry Period. The Promoter will then verify their entry before organising the prize to be awarded. Where a Qualifying Transaction was made on behalf of an Eligible Business, the prize will be awarded to the Eligible Business. All claims for instant win prizes must be received by 11:59pm AEST on 14/08/2023.

7.    Eligible Entrants that do not win an instant prize can visit www.wemakepossible.com.au, follow the prompts to the competition entry page, complete the online entry form, and submit an entry into the unclaimed prize draw for any prizes that remain unclaimed at the end of the Promotional Period. Entries into the unclaimed prize draw must be received during the Entry Period.

8.    Multiple entries permitted, subject to the following: (a) only one (1) digital scratch card will be sent per Qualifying Transaction regardless of the amount spent in that transaction in excess of $250 (inc GST) and (b) each entry/prize claim must be submitted separately and in accordance with entry requirements.


9.    The Promoter reserves the right, at any time, to verify the validity of entries, prize claims and Eligible Entrants (including an Eligible Individual’s identity, age and place of residence and an Eligible Business’ place of operation and/or ABN) and reserves the right, in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

10.    Incomplete or indecipherable prize claims/entries will be deemed invalid.

11.    If there is a dispute as to the identity of an Eligible Individual, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Individual.

13.    The names of any ACT winners or SA winners will have their names published online at www.wemakepossible.com.au on 16/08/2023.

14.    The Promoter’s decision is final and no correspondence will be entered into.

15.    Winners are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by a winner be incorrect. 

16.    Any ancillary costs associated with redeeming a gift card are not included. Any unused balance of a gift card will not be awarded as cash. Redemption of      a gift card is subject to any terms and conditions of the issuer including those specified on the gift card.

17.    Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited. 

18.    If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

19.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

20.    A draw for any unclaimed prizes may take place on 31/08/2023 at Kwik Kopy, 9/50 Berry Street, North Sydney NSW 2060 at 11:00am, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email within two (2) business days of the draw. In the event of any winners from ACT or SA, their names will be published online at www.wemakepossible.com.au on 04/09/2023.

21.    Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23.    Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

24.    Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool and remain unclaimed will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
